Last Updated: July 11, 2025

Welcome to RateMyPreceptor! Please read these Terms and Conditions ("Terms") carefully before accessing or using our website and services (collectively, the "Service").

By clicking "Agree" or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

1. Acceptance and Modification of Terms

We may modify these Terms at any time, in our sole discretion. Material changes will be posted on this page with an updated "Last Updated" date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

2. Eligibility, Age Limits & Verification

  • Age Requirement. You must be at least 18 years old to submit a review or rating.
  • No Children Under 13 (COPPA). The Service is not directed to children under 13, and we do not knowingly collect personal information from them. If we learn that we have collected such data, we will delete it.
  • Program Requirement. You must be a current or former student in a recognized health‑profession program that requires clinical rotations (e.g., medicine, nursing, PA, pharmacy).
  • Verification. We may request proof of your status (e.g., educational e‑mail, enrollment letter, clinical badge). Failure to provide satisfactory proof may result in removal of your content and/or restriction of future submissions.

3. Browsing & Optional Account

You may browse the site and submit reviews without creating an account. Optional accounts unlock extra features (e.g., upvoting and downvoting reviews). If you create an account, you are responsible for safeguarding your credentials and all activity that occurs under it.

4. User‑Generated Content ("User Content") & Feedback

  • Responsibility. You are solely responsible for the User Content you post and affirm that it reflects your personal, firsthand experience.
  • License. By posting User Content, you grant RateMyPreceptor a perpetual, irrevocable, non‑exclusive, royalty‑free, worldwide, fully‑paid, and sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display that content in any media.
  • Feedback. Any feedback, ideas, or suggestions you send us are considered non‑confidential. You grant RateMyPreceptor an unrestricted right to use such feedback for any purpose without compensation to you.

5. Content Guidelines and Prohibited Conduct

User Content must not:

  1. Violate Patient Confidentiality (HIPAA). Absolutely no Protected Health Information (PHI) or other identifiers that could reveal a patient's identity. Violations will result in immediate removal and possible ban.
  2. Be Unlawful or Defamatory. No knowingly false, misleading, or libelous statements; reviews are opinions, not statements of fact.
  3. Be Abusive or Hateful. No harassment, threats, discrimination, obscenity, or hate speech.
  4. Infringe on Rights. No violation of intellectual‑property or privacy rights of others.
  5. Contain Personal Information. Do not post private contact details (phone numbers, personal e‑mails, home addresses) for preceptors or anyone else.
  6. Be Commercial in Nature. No spam, advertising, or solicitation.
Takedown Transparency. We may remove or edit any User Content at our sole discretion. Except in urgent or legally restricted situations, we will make reasonable efforts to notify you within 7 days of the removal.

6. Disclaimers, Third‑Party Links & Tracking Technologies

  • Accuracy Disclaimer. We do not verify and cannot guarantee the accuracy or usefulness of User Content. Use it at your own risk.
  • No Professional Advice. Content is for informational purposes only and is not professional, legal, medical, or career advice.
  • Third‑Party Links. The Service may contain links to third‑party websites or resources. We are not responsible for their content, products, or services.
  • Cookies & Analytics. We use cookies and similar technologies for analytics and functionality. Details and opt‑out options are provided in our Privacy Policy.

All content, software, trademarks, logos, and service marks on the Service (excluding User Content) are the exclusive property of RateMyPreceptor and protected by intellectual‑property laws. You may not use our IP without prior written consent.

8. Copyright Infringement (DMCA Policy)

If you believe material on the Service infringes your copyright, please follow the procedure outlined in our separate DMCA Policy page.

We may suspend, block, or terminate your access to the Service—by IP address, device, account (if any), or otherwise—at any time, without notice, for any reason, including breach of these Terms.

10. Indemnification

You agree to defend, indemnify, and hold harmless RateMyPreceptor, its affiliates, and their officers, directors, employees, and agents from and against any claims, damages, liabilities, and expenses (including attorneys' fees) arising out of your use of the Service or your violation of these Terms.

TO THE FULLEST EXTENT PERMITTED BY LAW, RATEMYPRECEPTOR WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES (INCLUDING LOST PROFITS OR GOODWILL) ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Arkansas, USA, without regard to conflict‑of‑laws principles. Any dispute shall be resolved by binding arbitration in Little Rock, Arkansas, under the rules of the American Arbitration Association. The arbitration shall be conducted on an individual basis; class‑action and jury‑trial waivers apply. The arbitrator's decision is final and may be entered as a judgment in any competent court.

  • Export Compliance / Sanctions. You represent that you are not located in, or a resident of, any jurisdiction subject to U.S. trade sanctions and are not on any U.S. government list of prohibited or restricted parties.
